Unloading Release

National Ready Mix/ National Block is not responsible for any damages to sidewalks, driveways, buildings, trees, shrubbery, etc. when delivery is made inside the lot line at the customer’s request.

Contractor does hereby indemnify and hold harmless National Ready Mix/ National Block any said damages claimed by the property owner.

Signature on Ready Mix ticket authorizes National Ready Mix to use private driveway for making delivery and customer assumes full responsibility.

  Freshly Mixed Concrete, Mortar or Grout may cause eye or skin injury.

Take these precautions:

1. Avoid all contact with eyes.  Wear rubber boots and gloves and avoid prolong contact directly with skin or through porous materials.
2. In case of contact with eyes or skin, FLUSH THOROUGHLY WITH WATER.
3. If irritation persists, get medical attention promptly.
4. Keep children away.

Indemnification:  The purchaser agrees to the fullest extent permitted by Michigan law to defend, hold harmless National Ready Mix/ National Block and any of its directors, board members, shareholders, agents, servants, or employees against any claims or liabilities whatsoever, including but not limited to all claims, suits, actions, costs, attorney fees, expenses, damages, judgments, or decrees, resulting from bodily injury, sickness, disease, damage to or destruction of any property, including loss of use thereof, arising out of, any way related to or connection with National Ready Mix/National Block’s manufacturing, production or delivery of any materials or the performance of any materials or work, including any extra materials or work later agreed to, whether the result of actions or omissions, negligence or otherwise of National Ready Mix/ National Block , its directors, board members, shareholders, agents, servants, or employees, whether or contributed by National Ready Mix/ National Block .  The purchaser shall not be required to defend, hold harmless or indemnify National Ready Mix/National Block for, or against, injury or sickness of person or damages to property resulting from the sole negligence of National Ready Mix/ National Block.

Acceptance/Rejection:  All materials are deemed accepted as the date of delivery, upon any alteration or modification of the materials, and/or any use or implementation of materials.  In the event the Purchaser rejects materials, Purchaser shall timely provide National Ready Mix/ National Block written notice of rejection stating the reasons for its unacceptability, and purchase will terminate with respect to those materials.  National Ready Mix/ National Block shall be entitled to timely payment for all materials accepted.

No Storage:  National Ready Mix/ National Block shall not be responsible for storage or for providing storage for any materials returned or failed to be picked up.  All materials accepted by the Purchaser are the sole responsibility of the Purchaser.  To the extent any materials are damaged, claimed to be damaged, defective, or claimed to be defective as a result of or during the time in which the materials are stored at National Ready Mix/ National Block’s facilities the damages and /or defects, claimed or otherwise, are the sole responsibility of the Purchaser.

Payment Terms:  Full payments for all materials are due to National Ready Mix/ National Block within 30 days unless otherwise indicated of receipt of each statement.    Payment will be in U.S. currency.  Payment terms are firm unless changed by written mutual agreement of the parties.  Payments due and unpaid shall bear interest from the date payment is due at the rate of 1.5%.  Purchaser agrees to pay for total material ordered and will be billed as material is shipped.  Any order material remaining at the completion of the job will become the property of the purchaser and will be billed accordingly.  A 50% handling will be issued for material returned.

Special Order Block:  Allow adequate lead time for production on special orders.  Your cooperation will help job delays.  Any item of less than 1000 blocks will be charged $350.00 for set up time.  If additional blocks require another production run, a set up charge will be billed to cover production costs.

Warranty Disclaimer:  EXCEPT AS EXPRESSLY PROVIDED HEREIN, NATIONAL READY MIX/ NATIONAL BLOCK MAKES NO OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, REGARDING MATERIALS, ITS MERCHANTABILITY OR ITS FITNESS FOR ANY PARTICULAR PURPOSE
